Background

In spring 2013 the European Commission presented its "Proposals for Reform of the EU Trade Mark System" which comprises the concept of the certification mark (Art. 74b – Art. 74k). While the UK (and also the U.S.) is familiar with this concept, the rather formal German trademark law expects severe problems to implement this new concept into its understanding of basic trademark concepts (TM functions, use requirement, etc.). As apparently no one opposes the concept as a whole, discussions on the implementation should at least make a start.
